Provider Authority and Spiritual Discernment

All Services Subject to Provider Discretion

All spiritual services are provided solely at the provider’s absolute discretion and, where applicable, following spiritual authorization.

General Service Principles:

The provider retains sole authority to determine appropriateness, timing, methodology, and scope of all services
The provider may decline, redirect, or modify any requested service based on spiritual guidance or professional judgment
Decisions regarding service delivery, modification, or refusal are final and not subject to appeal or dispute
Purchase of a service does not guarantee delivery in the exact form requested

Services Requiring Spiritual Authorization

Certain services—including but not limited to custom spellwork, advanced ritual work, and intensive healing sessions—require spiritual authorization before proceeding. For these services:

Clients purchase services prior to work commencing
Following purchase, clients submit detailed intake information via confidential form (where applicable)
The provider brings requests to aligned spirit guides for authorization and discernment
Spiritual guidance determines whether the work is appropriate, aligned, and able to proceed
If work is approved: Client is notified and service proceeds as purchased
If work is declined: Client receives immediate notification and full refund

Provider Discretion and Non-Obligation:

Purchase does not obligate the provider to perform requested work
Spiritual authorization is determined by the provider’s guidance, not client preference
The provider may decline any work without providing detailed justification
Decisions are final and not subject to dispute

Client Acknowledgment:

By purchasing any service, you acknowledge and agree that:

Payment does not guarantee delivery in the exact form requested

No Warranty of Protection or Results:

Specific manifestations, effects, or results of any kind

Consultation and Service Performance

Paid consultations for any service—including but not limited to spellwork, energetic healing, or advisory services—are provided for assessment, discussion, and exploration purposes only.

Consultation does not constitute a commitment to perform the service discussed
The provider may determine, following consultation, that a service is not appropriate, aligned, or within scope
Refusal or modification of service following consultation does not constitute breach of contract
Clients acknowledge that consultation fees cover the provider’s time, expertise, and assessment, regardless of service outcome
Alternative approaches or referrals may be offered in cases where requested services are declined

Informed Consent and Assumption of Risk

By purchasing ANY of our services, you provide informed consent and acknowledge the following risks:

Client Affirmation

By engaging with our services, you affirm that:

You are emotionally stable and mentally fit to participate in spiritual, energetic, and introspective practices
You are responsible for your own mental and emotional wellbeing before, during, and after engaging with our services
You understand that spiritual work may surface emotional material and you are prepared to manage such experiences responsibly
You will seek appropriate professional mental health support if needed
You are not in acute psychological crisis or distress requiring immediate professional intervention

Provider Non-Responsibility

The provider is not responsible for:

Emotional reactions, psychological distress, or integration challenges arising from services
Pre-existing mental health conditions or vulnerabilities
Your capacity to process, integrate, or respond to spiritual content or experiences
Any decision you make regarding your mental health care or therapeutic needs

If you are currently experiencing mental health challenges, we strongly recommend engaging appropriate professional support alongside or instead of spiritual services.

No Third-Party Rights or Claims

Third-Party Exclusion

These Terms create rights and obligations solely between you (the client) and the provider. No third party has any rights, claims, or standing under this agreement.

Services are not designed, intended, or warranted to affect, harm, benefit, or influence any identifiable third party
Any language regarding justice, protection, containment, consequence, or similar concepts refers to spiritual and symbolic frameworks only
The provider does not verify, confirm, investigate, or adjudicate the accuracy of client narratives regarding third parties
No third party may bring claims against the provider based on services provided to you
You agree not to assert that services were intended to or did affect any third party in any legally cognizable manner

Client Narrative and Verification

You acknowledge that:

The provider relies on your representations regarding your circumstances
The provider does not independently verify facts, relationships, or situations you describe
You are solely responsible for the accuracy and completeness of information you provide
The provider’s services are based on your subjective experience and perspective, not objective investigation

Program Timelines and Delivery Schedule

We are committed to delivering high-quality spiritual education that meets the evolving standards of the Nightshade Sanctum™. For this reason, some programs—particularly during their first live teaching cycle—may have flexible timelines.

Course content, class delivery, and support materials (such as manuals, recordings, and resources) may be created and released in real time. We reserve the right to extend program durations beyond originally projected timeframes in order to uphold the highest standards of teaching, spiritual integrity, and energetic alignment.

Additionally, live classes may occasionally be rescheduled with short notice due to unforeseen circumstances or energetic considerations. In such cases, reasonable efforts will be made to communicate changes in a timely manner and to provide recordings or alternative sessions where applicable.

By enrolling in our programs, you acknowledge and accept the fluid nature of our sacred work and understand that timelines may shift as part of the organic unfolding of our offerings.

Timeline Expectations in Promotional Materials

Any durations, timelines, or start/end dates shared in program descriptions, marketing emails, or promotional materials are indicative only and not contractually binding. All timelines are subject to adjustment in service of energetic alignment, content quality, and spiritual integrity.

First Round and Evolving Programs

By enrolling in the first round or early version of any newly offered program, you acknowledge that the program may be delivered in a dynamic and evolving format. These offerings are often created in real time, with classes, manuals, and materials developed as the journey unfolds. As such, delivery timelines may extend beyond initial projections to ensure high-quality, energetically aligned teachings.

We reserve the right to refine, restructure, or evolve the program content, delivery schedule, and format as needed. This flexibility is essential to maintain the high standards of the Nightshade Sanctum™ and to honor the creative and spiritual integrity of the work. Future versions of the same program may differ in structure, pace, and content.

Age Requirement

By accessing our websites, enrolling in our programs, or using our services, you confirm that you are at least 18 years old. Our content is designed for adults, and participation is limited to those legally permitted to enter into binding contracts.

If we learn that a minor has enrolled under false pretenses, we reserve the right to terminate access and delete associated accounts.

Recurring Payments

Refund and Cancellation Policy

Services Requiring Spiritual Authorization

This includes but is not limited to: custom spellwork (including Vindicta), advanced ritual work, intensive healing sessions, and other services where spiritual authorization is required.

Purchase and Approval Process:

These services are subject to spiritual authorization following intake submission
Purchases are made before work commences and before spiritual approval is confirmed
If work is spiritually approved and proceeds: All sales are final once work begins
If work is declined following spiritual review: Full refund is provided immediately

No Partial Refunds:

Once any service has been spiritually authorized and commenced, no refunds will be provided under any circumstances
Refunds are not provided based on client satisfaction, perceived outcomes, disagreement with results, or claims that services were ineffective
Refunds are not provided if client changes mind after service delivery has begun
Refunds are not provided for delayed results, lack of visible results, results contrary to client expectations, or claims of inaccuracy

Client’s Sole Remedy:

In cases where work is declined before delivery, the client’s sole and exclusive remedy is the full purchase price refund. Client waives any additional claims, damages, or remedies beyond this refund.

Risk Acknowledgment:

By purchasing services requiring spiritual authorization, you acknowledge that:

You accept the risk that work may be declined after purchase

Your sole protection against declined work is the full refund policy

Masterclasses and Group Programs

Limited Refund Window: Refunds available within 7 days of purchase if no content has been accessed
Partial Completion: No partial refunds for partially completed programs

Intellectual Property Rights

This includes using Zela Feraco’s intellectual property to train AI systems or create derivative works for public or commercial use
Violation of this clause may result in immediate termination of access to all services and potential legal action for intellectual property infringement

Use of Materials and Recordings

All live sessions may be recorded for the benefit of participants and these recordings are the property of Zela Feraco
Recordings may not be shared, uploaded, or distributed outside the intended learning platform
Screenshots, replays, or excerpts from any live, recorded, or written content may not be shared outside the intended platform or learning context
Content is provided for your personal educational use within the program structure only
Participants found redistributing content without permission may be permanently removed and barred from future offerings
This includes sharing content in other online communities, social media platforms, or with individuals not enrolled in the specific program

Marketing and Testimonial Use

Content Usage Rights

By participating in our courses, programs, consultations, and community spaces, you grant us permission to use:

Written testimonials (e.g., feedback forms, email responses, comments in community groups, or private messages)
Screenshots of conversations, feedback, or public praise (with identifying details redacted when appropriate)

Certification Programs

We will never disclose sensitive client details or private content from within sacred spaces.

No Financial Compensation

By agreeing to these terms, you understand that the use of your testimonial or story does not entitle you to any financial compensation or royalties, unless explicitly agreed otherwise in writing.

Your Content

You retain ownership of content you create (testimonials, assignments, posts)
By participating in our programs, you grant us permission to use your content for promotional purposes
We may feature your success stories, testimonials, and transformations in our marketing materials

Participant Submissions and Ownership

Any materials you create and submit during our programs (including but not limited to assignments, reflections, rituals, practices, and written content) remain your intellectual property

Prohibited Conduct

Consequences

Violations may result in warnings, removal from specific programs, or complete account termination
No refunds will be provided for terminations due to policy violations

Protection of Community Integrity

Anti-Harassment and Reputation Protection

We reserve the right to protect the integrity and safety of our community
Any behavior—including public defamation, harassment, false accusations, or coordinated disruption—directed toward Zela Feraco, her business, or community members may result in removal from all platforms and legal follow-up if necessary
We respect constructive feedback and address legitimate concerns through appropriate channels, but we will not tolerate targeted hostility or misuse of spiritual community channels for personal attacks
This protection extends to all community members, creating a safe space for spiritual growth and learning
Violations of this policy may result in immediate termination of access to all services without refund

Constructive Resolution

Public Figure & Brand Reputation Protection

As a public-facing educator, spiritual leader, and business owner, Zela Feraco reserves the right to protect her personal and professional reputation, including on social media and in public forums
Defamation, slander, libel, or misleading public claims made by program participants, clients, or third parties—whether verbal, written, or digital—may result in legal action, including but not limited to removal from all offerings without refund and pursuit of damages under Swiss civil law
This clause applies to current and former students, affiliates, and collaborators
We distinguish between legitimate feedback (which we welcome through appropriate channels) and malicious attacks designed to damage reputation or business standing
Public disputes or grievances should be addressed directly with us rather than being aired in public forums or social media platforms

Independent Participation

No Agency or Endorsement

Enrollment in any program or training offered through NightshadeSanctum.com, ZelaFeraco.com, or SkyGardenTarot.com does not imply certification, endorsement, or permission to represent our business or teachings in any official capacity
Students, clients, and participants may not claim affiliation, mentorship status, or authorization to speak on behalf of Zela Feraco or the Nightshade Sanctum without explicit written permission
Participation in our programs does not grant you the right to use our business names, branding, or proprietary methods in your own professional offerings
You may not present yourself as a graduate, certified practitioner, or official representative of our programs unless specifically authorized in writing

Name and Brand Usage

Participants, clients, and third parties may not use, reproduce, or present any of the following brand names, course titles, or certification marks in a way that implies endorsement, affiliation, partnership, or certification by Zela Feraco, the Nightshade Sanctum™, Zela Feraco Coaching™, or Sky Garden Tarot™ without prior written consent.

You may not use these terms in your advertising, social media, teaching, events, workshops, courses, books, or materials in a way that suggests endorsement or official association.

Any unauthorized or misleading use of these names may result in legal action, including but not limited to cease-and-desist orders, removal from programs, and restriction of future access to offerings.
